EncoPath is operated by WholePath Technologies, LLC ("Company," "we," "our," or "us"). By accessing or using EncoPath ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

EncoPath is a health tracking application designed to help families manage and monitor encopresis-related symptoms, medications, and progress. The Service includes:

• Bowel movement tracking and calendar visualization
• Medication logging and reminders
• Photo documentation
• Multi-user access for caregivers
• Data export and reporting features

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account. Parents and guardians are responsible for the information entered about their children.

You agree NOT to:

• Use the Service for any illegal purpose
• Violate any laws or regulations
• Infringe on the rights of others
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Upload viruses or malicious code
• Impersonate another person or entity
• Share your account credentials with unauthorized users

EncoPath offers both free and paid subscription plans:

• Free Plan: Access to basic tracking features at no cost
• Basic Plan: $1/month with additional features
• Standard Plan: $5/month with full feature access

Payment terms:

• Subscriptions are billed monthly unless cancelled
• Payments are processed through our secure payment provider (Stripe)
• You can cancel at any time; cancellation takes effect at the end of the billing period
• We offer a 30-day money-back guarantee for new paid subscriptions
• Prices are subject to change with 30 days' notice

All content and materials available through the Service, including software, text, graphics, logos, and trademarks, are owned by or licensed to EncoPath and are protected by copyright and other intellectual property laws.

You retain ownership of any health data you enter into the Service. By using the Service, you grant us a limited license to process and store this data solely for the purpose of providing the Service to you.

You own all data you enter into EncoPath. You can:

• Export your data at any time in PDF or CSV format
• Request a complete copy of your data
• Delete your account and all associated data

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EncoPath SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

You agree to indemnify and hold harmless EncoPath, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or the Service
• Exposes us to liability

Upon termination, your right to use the Service will immediately cease, but your data will be retained for 30 days to allow for data export if desired.

We may modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States and the State where EncoPath is operated, without regard to conflict of law principles.
